La globalizzazione e lo stallo del costituzionalismo. ‘Private governments', costituzionalizzazione del contratto e autonomia sociale: la proposta teubneriana
    in Teoria e storia del diritto privato , Numero 6 ,  2013 ,  19
Globalization points out State and public law's difficulties due to the borders' ongoing weakening and the particularly private centers of normative production's increase. Social autonomies avoid national grip and develop autonomous regulation spheres and it is unthinkable to reaffirm the State supremacy as a result of its skill of combining different interests into a general framework. Teubnerian proposal, the social constitutionalism, aims to a weak compatibility between different discourses: it derives from the private law contractual pattern and at the same time institutionalizes a self-restraint principle to protect sustainaibility of plurality.
